Terms and Conditions

These Terms and Conditions (T&Cs) govern the sale of web development services offered by Accura.dev. Any order implies unreserved acceptance of these T&Cs.

1. Purpose and scope

These terms apply to every service offered by Accura.dev, in particular:

• Audit, migration and development of production MCP servers
• Preparation and submission of a connector directory file
• Compliance watch and maintenance
• Design and development of landing pages
• Design and development of marketing websites
• Design and development of web applications and SaaS platforms
• Development work on a day rate basis
• AI business-process automation (script, workflow or API deliverable on the client's stack)

2. Services offered

2.3 Third-party costs and hosting modes

Landing page and marketing website: unless the quote says otherwise, Accura opens and manages the domain name and hosting (full service). Terms and any recurring fees are written in the quote. Application and SaaS: the hosting mode (Accura full service or client infrastructure) is stated in the quote. MCP servers, AI automation and work on the client’s infrastructure: the deliverable is deployed on the client's infrastructure and accounts. Hosting, domain and third-party costs remain theirs. Copywriting, photography and visual identity are not included unless agreed in writing.

2.4 AI business-process automation

AI automation engagements are quoted per project. They are not sold as a fixed package price in these terms.

• Scope and deliverable. Accura designs and delivers a script, workflow or API deployed on the client’s tools and infrastructure. The deliverable is not hosted or operated by Accura, unless the quote says otherwise in writing.
• Scope of work. The written quote sets the connected tools, the expected volume or load, the acceptance criteria and the price. Anything outside that scope is out of scope unless amended in writing.
• Ownership. After full payment, the delivered code and configuration belong to the client under article 7. Accura does not provide ongoing operation of the deliverable, unless agreed in writing (maintenance contract or amendment).
• Data and GDPR. Processing runs on the client’s infrastructure and accounts. Accura is not the host of the client’s data flows, unless the quote says otherwise. The client remains responsible for GDPR duties on their systems.
• Acceptance. The client has 30 days after delivery to report non-conformity with the agreed scope, under article 8.1. After that period, delivery is deemed accepted, subject to proven bugs handled under article 8.2.
• Exclusions. Unless agreed in writing, the following are not included: third-party SaaS licences, the client’s API tokens and subscriptions, model usage credits, and evolutionary maintenance or new features outside the quote.
• Price. Each engagement is covered by a written quote before work starts. These terms do not set a fixed package price for AI automation.

The infrastructure rules in article 9 (client stack) apply to these engagements.

3. Order and acceptance

The order becomes firm and final upon:

• Acceptance of the signed quote (electronically or handwritten)
• Receipt of the deposit payment (minimum 30%)
• Provision of the complete brief

A confirmation email will be sent within 24 hours.

4. Prices and payment terms

4.1 Prices

Prices are quoted in euros (€), excluding VAT for professionals and inclusive of all taxes (TTC) for individuals.

The displayed prices are firm and non-revisable during the duration of the project, except in the event of a substantial modification of the specifications.

4.2 Payment terms

• Deposit: 30% upon order
• Interim payment: 40% mid-project (if applicable)
• Balance: 30% upon delivery

Accepted payment methods: bank transfer, bank card (via Stripe/Polar).

4.3 Late payment

In the event of late payment, penalties equal to three times the legal interest rate will be applied, as well as a fixed indemnity of €40 for collection costs.

5. Timelines and delivery

The announced timelines are indicative and start upon receipt of:

• The deposit
• The complete brief
• All necessary elements (content, access, etc.)

Any delay in the provision of elements by the client results in a proportional postponement of the delivery time.

6. Revisions and changes

Each service includes:

• MCP server audit: 1 round of questions and clarifications on the deliverable
• Migration to the 2026-07-28 spec: 2 revision rounds
• Production MCP server: 3 revision rounds
• Landing page: 1 revision round
• Marketing site: 2 revision rounds
• Custom web application: 3 revision rounds
• Full SaaS product: 3 revision rounds

Beyond that, revisions are billed at an hourly rate of EUR 80.

Substantial changes to the scope are subject to a pricing amendment.

7. Intellectual property

Once full payment has been received:

• The source code belongs to you (open license, no lock-in)
• You have all rights to use, modify and exploit
• Accura.dev reserves the right to present the project in a portfolio (unless otherwise contractually stated)

8. Warranties and maintenance

8.1 Conformity warranty

30-day warranty after delivery for any non-conformity with the agreed scope. For a migration sprint, the warranty covers conformity with the specification revision named in the contract.

8.2 Bug fixing

Confirmed bugs are fixed free of charge for:

• Migration sprint: 30 days
• Production MCP server: 90 days

8.3 Maintenance and monitoring

Beyond the warranty period, compliance monitoring is offered as a monthly subscription. Since the protocol evolves through an RFC process, no engagement can guarantee permanent conformity without continuous follow-up.

9. Infrastructure and hosting

Two regimes, depending on the engagement:

• Landing pages and websites (and application or SaaS when the quote says so): Accura opens and manages domain and hosting (full service). The client keeps ownership of the code and accounts. Day-to-day operations may stay with Accura. Details in the quote.
• MCP, AI automation and work on client infra: deployed on your accounts. Hosting, domain and third-party costs are yours. Accura does not host or operate your MCP server or automation unless agreed in writing.

Acceptance into a third-party connector directory, in particular Anthropic's, is that vendor's decision. Accura.dev prepares and submits the package in line with the applicable policy, but cannot contractually guarantee acceptance.

10. Liability

Accura.dev cannot be held responsible for:

• Content provided by the client (texts, images, legal compliance)
• Service interruptions due to third-party hosting providers
• Indirect damages (loss of revenue, etc.)
• Use of the site/application by the client after delivery

Accura.dev's liability is limited to the amount paid for the service concerned.

11. Cancellation and termination

11.1 By the client

In the event of cancellation by the client:

• Before start: 30% retention (administrative fees)
• During the project: payment proportional to the work performed

11.2 By Accura.dev

Accura.dev may terminate the contract in the event of:

• Non-payment after formal notice
• Serious breach by the client of their obligations
• Force majeure

12. Right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for services fully performed before the end of the withdrawal period and whose performance began with the consumer's agreement.

13. Data protection

The data collected is processed in accordance with the GDPR. For more information, see our Privacy Policy.

14. Applicable law and disputes

These T&Cs are governed by French law.

In the event of a dispute, we favor an amicable resolution. Failing that, the French courts shall have exclusive jurisdiction.
